PLEASE NOTE:
• Smoking is not permitted in the house.
• No parties or large gatherings without prior approval in writing. Property is located in a residential area; tenants are required to be in compliance with local noise ordinances.
• No music to be played outside past 10:00PM.
• No pets, hazardous materials, or firearms are allowed on property during time of occupancy.
• Please no tampons or condoms in the toilets. Plumbing bills resulting from blockages or inappropriate use of plumbing will be at the expense of Tenant(s).
• The floors throughout are hardwood - No stilettos or high heels to be worn on wood floors.
• Check in at: 4:00PM/Checking out at 10:00 AM.
CHECK OUT PROCEDURE
• No need to strip linens from beds.
• Procedure upon checkout Include; all dishes put in dishwasher, counter tops and appliances left clean, trash taken out to designated trash disposal for property.
• Full completion of check out procedure will ensure a successful checkout free of additional cleaning charges. Any extra or heavier cleaning will incur an additional charge.
POOL HEATING POLICY
May 15th –August 30th: Pool heating of 82 degrees during daylight hours (9:00 am – 5:00pm.) is included. If you would like the temperature higher than 82 degrees up to 85 degrees during daylight hours (9:00 am – 5:00pm there is an additional daily fee $59.00/DAY. Use of Jacuzzi does not incur any additional fees – and it heats up in about 30 minutes.
Sept 1st -May 15th: The fall, winter and spring months of Sept - April can be slightly chilly at times here in LA and many guests choose not to utilize the pool. Heating the pool in those months is often times difficult due to the drop in temperatures overnight.
If guests would like to heat the pool (During daylight hours 9:00am to 5:00pm) a fee of $169.00. per day and a 3-day minimum is required. Due to weather conditions, it cannot be guaranteed that the pool will sustain temperature above 81 degrees in winter months. Maximum temp that pool will attempt to heat to in winter months daylight hours is 83 degrees. Use of Jacuzzi does not incur any additional fees – and it heats up in about 30 minutes.
CHILDPROOFING DISCLOSURE:
• OWNER HEREBY CONFIRMS THAT THE HOUSE AT 2665 CHARL PLACE, LOS ANGELES, CA 90046 HAS IN NO WAY BEEN CHILD-PROOFED.
• IT DOES NOT COMPLY WITH CURRENT CHILD SAFETY STANDARD REGULATIONS (INCLUDING, BUT NOT LIMITED TO, DOOR ALARMS AND POOL FENCING). FOUNTAINS, SWIMMING POOL, JACUZZI, GARDEN WALL, AND ELECTRIC GATE MAY BE HAZARDOUS TO CHILDREN.
• TENANT(S/CLIENT) IS AWARE THAT ANY AND ALL CHILDREN ON THE PREMISES ARE THE SOLE RESPONSIBILITY AND LIABILITY OF THE TENANT/CLIENT.
• The Tenant(s)/CLIENT agrees to forever indemnify, defend and hold harmless in all circumstances the Owner, his employees or representatives, including but not limited to Michael Cianfrani, from and against any and all liability, loss, demand, judgments or other expenses (including but not limited to, defense costs, expenses and reasonable attorney fees) as a result of any problems, accidents, or physical harm that may occur to any person or persons not listed on this contract (including but not limited to any and all children) as well as Tenant(s)CLIENT’S possessions on the premises at any time.
With any stay of 29 days or more, the tenant will be responsible for all electric bill utilities. Pool heating charges are applied via the formula above.
OCCUPANTS acknowledge and agree that their compliance and cooperation with this community's appeasement program is a condition of this lease. OCCUPANTS agree to abide by all applicable city codes related to noise, trash containers, vehicle parking, property maintenance, occupancy overcrowding, and similar regulations intended to preserve and enhance the residential environment. OCCUPANTS acknowledge and agree that failure to comply and cooperate with this program may adversely affect the property right and values of landlord. OCCUPANTS further agree that failure to comply and cooperate is cause for immediate termination of this lease, eviction from the premises and forfeiture of all of OCCUPANT'S Security deposit and payment of any and all City fines that may result. If in fact there are any police calls, said police call or disturbance of neighbors shall be considered a breach of contract and OCCUPANTS shall be immediately removed from the property. OCCUPANT shall be responsible for all fines that may accrue during the course of OCCUPANT’s stay. OCCUPANT hereby authorizes OWNER to remove any and all OCCUPANTS from the property in the event of a disturbance and any other reason as to the jeopardization of the safety of others or whatever reason.
MAXIMUM OCCUPANCY
The maximum number of persons allowed to stay in the Property is limited to four (6), unless the Owner gives prior written consent.
A charge of $250.00 per person per night will be assessed for each person who stays in the Property in addition to the Rental Party. Guest will be charged without notice for additional persons staying in the Property and not disclosed to Owner.
Occupancy is limited to the person or persons originally listed on this contract as tenants. Any additional tenants or occupants must be approved in writing by OWNER. Failure to comply and cooperate is cause for immediate termination of this lease, eviction from the premises and forfeiture of all of OCCUPANT'S payments. Any additional occupants not originally on lease will cause an incurring of extra rental fees of $250.00 per night per person to be deducted from security deposit and subject to immediate termination of lease.
A visitor is an occupant of the Property who is not staying overnight . Any visitor staying overnight is subject to additional charges.
CLEANING
A cleaning fee of $250.00 will be charged to the Guest. Daily housekeeping services are not included in the rental rate. Throughout the rental period, Guest will be responsible for keeping the Property clean and in good condition. Any unsafe or dangerous condition must be reported to Owner immediately. Guest acknowledges that on the Arrival Date, the Property is in good condition, except for any defect Guest may report to Owner by the end of the first day following the Arrival Date. The Property should be left in the same condition as it was found by Guest on the Arrival Date. Guest promises to leave the Property in good repair.
ACTS OF GOD
If there is a storm or severe weather and a mandatory evacuation order is issued by state or local authorities, Guest shall be entitled to a prorated refund for each night Guest is unable to occupy the Property. Owner will not be liable or deemed in default under this Agreement for any failure to perform or delay in performing any of its obligations due to or arising out of any act not within its control, including, without limitation, acts of God.
Guest acknowledges that the use of the Property by the Rental Party and Guest’s visitors is entirely at their own risk. Guest will indemnify and hold harmless Owner from any and all expenses, costs, damages, suits, actions, or liabilities whatsoever arising from or related to any and all loss of or damage to personal property, including injury or death resulting from the use or occupancy of the Property or the failure of any member of Rental Party or Guest’s visitors to observe the rules and restrictions set forth in Paragraph 7.
VIOLATION OF AGREEMENT
If Guest or any member of the Rental Party violates any of the terms of this Agreement, including but not limited to maximum occupancy, visitors and rental rules and restrictions, Owner may evict Guest and the Rental Party from the Property and Guest will forfeit all rent and security deposit paid.
GOVERNING LAW
This Agreement and all transactions contemplated by this Agreement will be governed by, and constructed and enforced in accordance with the laws of the State of California (not including its conflicts of laws provisions). Any dispute arising from this Agreement shall be resolved through mediation.
